Belleza Contract

The first payment is a non-refundable retainer. At a minimum, Client agrees that the retainer fee fairly compensates Provider for committing to provide the Services and turning down other potential projects/clients. Deposits are nonrefundable. Deposit is non refundable. You may receive remaining balance if you need to cancel 30 days prior to party. Unforeseen circumstances consist of:  War, riot, terrorism, natural disaster, fire, explosions, flood, death, and destruction. Clients receiving our promotional sales please note all sales are nonrefundable and payment in full is required. The sales are transferable, and you are able to reschedule up to 1 year from original date. Rescheduling party is also a option for unforeseen circumstances. We appreciate your understanding that unexpected situations can arise. To cancel or reschedule, please reach out to us at least 30 days before your booking. If you don't cancel in the approptiate time frame, we won't be able to provide a refund however you will have the option to reschedule your booking up to 1 time if it's canceled. Belleza Event Space Rental Agreement: Renter must be over 21 years of age. This Venue is for private parties and events. RESERVATION: 50% of rental fee due upon signing contract. This fee ensures reservation of your event time slot and is not refundable for any reason. DAMAGES: If breakage, damage, loss, or additional expenses are incurred the undersigned agrees to reimburse Belleza for the excess within two days. Face painters have to be approved by Belleza and are required to have mat under their set up while working and prohibited to have set up against the walls. In the case that face paint is found on the floor, bounce houses, or wall; client agrees to pay a $300 damage/cleaning fee. RENTAL CHARGE: Full Rental fee is due 30 days prior to the event. Event shall be cancelled if the fee is not received on time. Rental fee is not refundable. Attaching to walls/ceiling/lights have to be approved by the Owner of Belleza first. NOT PERMITTED: Smoke producing devices. Smoking inside. Tents or campers. Fireworks. Blocking two exit doors clearly marked with EXIT signs. Excessive use of drapes to create a fire hazard. No animals are allowed. KITCHEN USE: Kitchen is for non-cooking purposes only. ALCOHOL: The Renter must follow all ABC of NC rules and any applicable laws in serving alcohol and food. Belleza only allows alcohol for guests invited at a private party by the renter, free of charge. Selling alcohol is not permitted under any circumstances. The renter is solely responsible for monitoring and control of the alcohol at their event, including preventing access by minors. Belleza does not provide alcohol or food under any circumstances. SMOKING: No smoking is allowed inside the building. CATERING: The Renter can hire a professional licensed caterer of their choice or assume liability of self-serving food. TRASH/CLEANING: Cleaning is provided by the Venue. All trash must be in the trash bags not thrown on the floor and taken to the dumpster outside, located on at the end of the building. (As soon as you exit building make a right) Please put all leftover food in trash bags (No food is to be left in kitchen or refrigerator). If there is trash left over there is a $500 charge. REMOVING BELONGINGS: Renter is required to remove all their belongings and accessories after event! This includes all food, drinks, packages, furniture, decorations and anything else brought in by the host or their vendors. This includes DJ and their equipment. Anything left behind will be disposed and disposal charges will apply. I hereby voluntarily fully waive, release, and forever discharge, indemnify and hold harmless RELEASED PARTIES from any and all claims, demands, causes of action, responsibilities or liabilities, for any kind of injuries, including death, or any kind of damages, which in any way arise out of or are in any way connected with my participation in any or all activity at Belleza or my use of Belleza equipment or facilities, or any act or omission of the RELEASED PARTIES including negligence. By signing this waiver, I am giving up my rights and the rights of my spouse and children and wards to sue Belleza for any injury, including paralysis or death, caused in whole or in part by the negligence or fault of Belleza. I hereby agree to indemnify, defend, and old harmless the RELEASED PARTIES from any and all liability, claims, suits, demands, causes of action, expenses of litigation, including but not limited to attorneys fees and costs which arise out of or are connected to injury. In consideration of being permitted by Belleza LLC (“Belleza”) to participate in its activities and to use its equipment and facilities, I hereby agree to release, discharge indemnify, and hold harmless, its agents, owners, members, shareholders, directors, employees, volunteers, manufacturers, participants, lessors, related and affiliated entities, successors, and assigns (collectively, the “RELEASED PARTIES”), on behalf of myself, my spouse, my children and all parties. EQUIPMENT THEFT/DAMAGE In the event that equipment provided by Paradise Playland and Belleza  is damaged or lost due to the actions of customer, event attendees or of staff not employed by Paradise Playland and Belleza, Customer agrees to pay for all repair or replacement up to the the full value of the lost or damaged items, including air shipping and handling. Please be advised, any damage to rental products will result in fees being charged for loss/ damage. Which include henna, glitter, confetti, animals, or complete total lost. This damage includes, but not limited to the following: Damage from moving rentals that are to remain stationary Rental items not returned Theft Damage resulting from vandalism or intentional or improper use Any damage resulting from overturning (not weather related) Any damage resulting from use of the Rental Items in violation of any provision of this Agreement or violation of any law, ordinance or regulation Any Damage through third party Damage or loss will be assessed as soon as possible after conclusion of the event. All visible damage will be photographed on site whenever possible. Paradise Playland LLC and Belleza LLC will provide a documented damage/loss report with costs included within 3 days after the event. Customer must pay for the damage or loss upon receipt from. Customer agrees pay for any additional charges if any theft/damages occurs.
